Our client was charged with Driving Under the Influence, and despite submitting to chemical testing that showed a BAC over the limit, Attorney Mike Doyle was able to successfully argue multiple hearings to suppress the breathalyzer result and to get the arrest quashed. Our client was stopped for improper lane use and submitted to both standardized field sobriety testing and a breathalyzer which yielded a BAC result over .08. Attorney Doyle was able to suppress the breathalyzer result because the arresting officer never gave our client the option to take the breathalyzer and instead forced him to take it by the roadside.
After the BAC was excluded, Attorney Doyle filed a motion to quash arrest and was able to prove to the court that the officer did not have probable cause to arrest our client. Not only was the DUI dismissed, but the suspension of our client’s license was rescinded and he now has valid driving privileges.
